Please read these Terms of Service ("Terms") carefully before using the KeepBuzz mobile application (the "App") operated by KeepBuzz Limited, Finance House, 46 Prussia Street, Dublin 7, Ireland D07 VW0Y ("we," "us," or "our"). By downloading, accessing, or using the App, you ("User") agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms, our Privacy Policy, and any additional terms and conditions that may apply. If you do not agree to these Terms, you must immediately cease using the App.

2. Use of the App

2.1. Eligibility: You must be at least 18 years old to use this App.

2.2. License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes.

2.3. USER CONDUCT POLICY FOR APP:

• BY USING THE APP, YOU AGREE TO ABIDE BY THE FOLLOWING TERMS AND CONDITIONS. ANY VIOLATION OF THESE RULES WILL RESULT IN IMMEDIATE ACTION, INCLUDING BUT NOT LIMITED TO ACCOUNT SUSPENSION, TERMINATION, AND/OR LEGAL ACTION.
• NO VIOLENCE: USERS ARE STRICTLY PROHIBITED FROM POSTING, SHARING, OR PROMOTING ANY FORM OF VIOLENT CONTENT. THIS INCLUDES PHYSICAL VIOLENCE, THREATS OF VIOLENCE, OR ANY MATERIAL THAT ENCOURAGES HARM TOWARD OTHERS.
• NO VIOLENCE: USERS ARE STRICTLY PROHIBITED FROM POSTING, SHARING, OR PROMOTING ANY FORM OF VIOLENT CONTENT. THIS INCLUDES PHYSICAL VIOLENCE, THREATS OF VIOLENCE, OR ANY MATERIAL THAT ENCOURAGES HARM TOWARD OTHERS.
• NO HARASSMENT OR BULLYING: ANY FORM OF HARASSMENT, BULLYING, OR TARGETED ATTACKS ON OTHER USERS OR INDIVIDUALS IS STRICTLY FORBIDDEN. THIS INCLUDES STALKING, MALICIOUS THREATS, OR DISCRIMINATION BASED ON GENDER, RACE, SEXUAL ORIENTATION, OR RELIGIOUS BELIEFS.
• NO HATE SPEECH: USERS MUST REFRAIN FROM ENGAGING IN, PROMOTING, OR DISTRIBUTING HATE SPEECH. THIS INCLUDES, BUT IS NOT LIMITED TO, LANGUAGE THAT INCITES VIOLENCE OR HATRED AGAINST INDIVIDUALS OR GROUPS BASED ON RACE, ETHNICITY, NATIONALITY, RELIGION, DISABILITY, GENDER, OR SEXUAL ORIENTATION.
• NO ILLEGAL CONTENT: USERS MAY NOT POST, SHARE, OR PROMOTE ANY ILLEGAL CONTENT ON THE KEEBUZZ APP. THIS INCLUDES BUT IS NOT LIMITED TO COPYRIGHTED MATERIAL WITHOUT PROPER AUTHORIZATION, PIRACY, DRUGS, FRAUD, AND ILLEGAL TRANSACTIONS. ANY CONTENT THAT VIOLATES LOCAL, NATIONAL, OR INTERNATIONAL LAWS IS STRICTLY PROHIBITED.
• NO PORNOGRAPHY OR SEXUALLY EXPLICIT CONTENT: USERS ARE STRICTLY PROHIBITED FROM POSTING, SHARING, OR DISTRIBUTING ANY FORM OF PORNOGRAPHY OR SEXUALLY EXPLICIT MATERIAL, INCLUDING BUT NOT LIMITED TO NUDITY, OBSCENE MATERIALS, OR SEXUAL ACTS.
• NO SPAMMING OR SCAMMING: USERS MAY NOT ENGAGE IN SPAMMING, SCAMMING, OR ANY FORM OF FRAUDULENT ACTIVITY. THIS INCLUDES THE USE OF MALICIOUS LINKS, PHISHING ATTEMPTS, OR ANY BEHAVIOR DESIGNED TO DEFRAUD OTHER USERS OR GAIN UNAUTHORIZED ACCESS TO PERSONAL INFORMATION.
  RESPECT FOR PRIVACY: USERS MUST RESPECT THE PRIVACY OF OTHERS. YOU ARE STRICTLY PROHIBITED FROM SHARING OR LEAKING PERSONAL INFORMATION WITHOUT CONSENT, INCLUDING BUT NOT LIMITED TO NAMES, ADDRESSES, PHONE NUMBERS, AND FINANCIAL INFORMATION.
• NO IMPERSONATION: USERS MAY NOT IMPERSONATE OTHERS, INCLUDING CELEBRITIES, PUBLIC FIGURES, OR OTHER USERS. ANY MISREPRESENTATION OF YOUR IDENTITY OR INTENT WILL BE GROUNDS FOR IMMEDIATE ACTION.
• RESPONSIBLE USE: USERS ARE EXPECTED TO USE THE APP RESPONSIBLY AND IN A WAY THAT CONTRIBUTES TO A POSITIVE AND SAFE COMMUNITY EXPERIENCE. CONTENT THAT DISRUPTS THE APP’S FUNCTIONALITY, VIOLATES COMMUNITY GUIDELINES, OR HARMS THE PLATFORM WILL NOT BE TOLERATED.
• REPORTING VIOLATIONS: A SPECIAL SECTION IS AVAILABLE IN THE SETTINGS OF THE KEEBUZZ APP WHERE USERS CAN REPORT ANY ISSUES RELATED TO VIOLATIONS OF THIS USER CONDUCT POLICY. USERS IS ABLE TO WRITE REPORTS ABOUT OFFENSIVE CONTENT, BEHAVIOR, OR ANY OTHER FORM OF VIOLATION THEY HAVE EXPERIENCED OR WITNESSED. ALL REPORTS WILL BE INVESTIGATED PROMPTLY.
  
• To Report Abuse:
  - Tap on the three dots at the top of the App home screen to access Settings.
  - Tap the Report Abuse button.
  - Provide a brief description of the issue.
  - Tap Submit.
• FAILURE TO COMPLY WITH THESE RULES WILL RESULT IN IMMEDIATE DISCIPLINARY ACTION, INCLUDING PERMANENT REMOVAL FROM THE KEEBUZZ PLATFORM. CONTINUED VIOLATION OR ILLEGAL ACTIVITIES WILL BE REPORTED TO LAW ENFORCEMENT AUTHORITIES AS NECESSARY. KEEPBUZZ LIMITED RESERVES THE RIGHT TO MONITOR, REMOVE, AND TAKE LEGAL ACTION AGAINST ANY USER OR CONTENT THAT VIOLATES THIS POLICY WITHOUT PRIOR NOTICE.

3. App Description

The App allows Users to capture images, record videos and audio, take notes, and create lists of preferred websites and online shops. Users can directly access external websites and shops listed within the App. By clicking on an external website, Users acknowledge that they will no longer be governed by the App Terms of Service and Privacy Policy but by the Terms of Service and Privacy Policy of the selected website. All content created within the App, in accordance with the App's Terms of Service and Privacy Policy, can be shared through the app or via any sharing platforms installed on the user's mobile device.

4. User Data and Storage

All user data, including but not limited to images, notes, and a list of websites, is stored both locally on the user’s mobile device and on our secure servers. We implement industry-standard security measures to protect user data while it is stored on our servers. These measures include encryption, access controls, and regular security assessments to ensure the highest level of data protection.

5. USER RESPONSIBILITY FOR DATA BACKUP

5.1. WHILE THE APP'S BACKUP OPTION HELPS PROTECT YOUR DATA AND ENHANCES SHARING AND SEARCH FUNCTIONALITIES, IT DOES NOT ENTIRELY ELIMINATE THE RISK OF DATA LOSS. THE ULTIMATE RESPONSIBILITY FOR YOUR DATA LIES WITH YOU, THE USER.

5.2. STRONGLY RECOMMEND REGULARLY BACKING UP YOUR DATA AND ENSURING IT IS SECURELY STORED.

5.3. BY USING THE APP, YOU AGREE THAT KEEBUZZ IS NOT LIABLE FOR ANY DATA LOSS, AND IT'S YOUR RESPONSIBILITY TO MANAGE AND SAFEGUARD YOUR INFORMATION.

6. Privacy Policy and Compliance with European Laws, Including GDPR

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KEEPBUZZ LIMITED, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF DATA, DATA CORRUPTION, DEVICE MALFUNCTION, OR LOSS OF USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

9.2. KEEPBUZZ LIMITED PROVIDES THE APP ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9.3. YOU AGREE THAT YOUR USE OF THE APP IS AT YOUR OWN RISK AND THAT YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE, LOSS OF DATA, OR ANY OTHER HARM THAT RESULTS FROM YOUR USE OF THE APP.

9.4. WHEN YOU CLICK ON ANY BANNER FOR OTHER BRANDS LISTED WITHIN THE KEEPBUZZ APP, YOU WILL BE REDIRECTED TO EXTERNAL WEBSITES. PLEASE BE AWARE THAT YOU WILL BE SUBJECT TO THE TERMS, CONDITIONS, AND PRIVACY POLICIES OF THOSE WEBSITES. WE DISCLAIM ANY CONTROL OVER THE CONTENT, PRACTICES, OR POLICIES OF THESE THIRD-PARTY WEBSITES.

9.5. KEEPBUZZ LIMITED DOES NOT HAVE ANY BUSINESS RELATIONSHIPS, OWNERSHIP STAKES, OR OTHER BUSINESS ASSOCIATIONS WITH THE COMPANIES LISTED ON SCREENS WITHIN THE KEEPBUZZ WEBSITE, WHICH ILLUSTRATE HOW USERS' FAVORITE WEBSITES WILL APPEAR ON THEIR "MY FAVORITES" LIST WITHIN THE KEEPBUZZ APP. THE INCLUSION OF THESE COMPANIES ON THE KEEPBUZZ WEBSITE IS SOLELY FOR ILLUSTRATIVE PURPOSES, DEMONSTRATING HOW USERS' CHOSEN WEBSITES WILL BE LISTED ON THEIR "MY FAVORITES" SCREEN FOR CONVENIENT ACCESS IN THE FUTURE.

10. INDEMNIFICATION

YOU AGREE TO INDEMNIFY AND HOLD HARMLESS KEEPBUZZ LIMITED, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND ANY INFLUENCERS COLLABORATING WITH KEEPBUZZ LIMITED FROM ANY CLAIMS, DAMAGES, LOSSES, LIABILITIES, AND EXPENSES (INCLUDING ATTORNEY'S FEES) ARISING FROM OR RELATED TO YOUR USE OF THE APP, YOUR BREACH OF THESE TERMS, OR ANY VIOLATION OF APPLICABLE LAWS.

11.1. We reserve the right to modify, update, or discontinue the App or any part thereof at any time without notice.
